ARTICLE I. Reservation and Agreement

By making a reservation and paying for the rented equipment (bicycle and accessories) through the Caretrade VOF rental website, which can be accessed via the link www.delagekempen.be, the renter agrees to the rental conditions of Caretrade VOF.

ARTICLE II. Ownership and Use

The rented equipment remains the exclusive property of Appel Recreatie NV for the entire rental period. The renter is not permitted to lend out the rented equipment, transport it in their own vehicle, or sublet it to third parties.

ARTICLE III. Age Restriction and Condition of Material

Electric bicycles are only rented to renters aged 16 and older. The rental equipment is returned with a fully charged battery. Caretrade VOF cannot be held liable for a dead battery.

ARTICLE IV. Inspection and Acceptance

When collecting the rented equipment, the renter must sign a rental form acknowledging receipt and use of the rented equipment. The renter confirms that the rented equipment is technically and legally in good order and agrees with the condition, size, and model of the rented equipment. Any comments regarding the condition, size, or model must be made known before signing the form.

ARTICLE V. Tenant's Responsibility

The renter must treat and maintain the rented equipment with care. They use the rented equipment at their own risk and must comply with the applicable highway code for the territory in question. All charges and fines resulting from violations during the rental period are the renter's responsibility. Caretrade VOF cannot be held liable for this under any circumstances.

The renter must return the rented equipment in the same condition as when they received it. The equipment must be returned to Caretrade VOF at the agreed time and location. Late returns will incur a fine of €10 (including VAT) per additional 15 minutes.

ARTICLE VI. Defects and Technical Problems

If the rented equipment becomes inoperable during the rental period, the renter must call the emergency number 32 478 43 80 33. This number is available from 9:00 AM to 7:00 PM during our rental season, and until 9:00 PM in July and August. A technician will be dispatched to assist if the situation is within Belgian Limburg or within a 30 km radius of the De Lage Kempen holiday park. Caretrade VOF will attempt to repair the defect or provide a replacement bicycle if it cannot be repaired. The renter cannot claim damages or interest for problems with the rental equipment.

ARTICLE VII. Indemnification

Caretrade VOF reserves the right to recover any damage to the rented equipment during the rental period from the renter by means of a repair invoice. The renter expressly agrees to this.

ARTICLE VIII. Loss and Theft

The renter is obligated to report any loss or theft of rented equipment to Caretrade VOF and the police within 24 hours. The renter is liable for any loss and/or theft, except in cases of force majeure. Force majeure is not accepted if the renter no longer has possession of the bicycle key.

ARTICLE IX. Compensation Rates

In the event of loss, theft, or damage to the rented equipment, compensation will be charged. An administrative fee of €100 (including VAT) will be automatically charged. In addition, damaged or stolen goods will be invoiced at the following rates:

Electric bicycle: 2000 euros

City bike: 750 euros

Children's bicycle: 500 euros

Locks, bags, child seats and all other rented accessories: 100 euros per lost or damaged item.

ARTICLE X. Cancellation Policy

The renter can cancel a reservation up to the day before the start of the rental period. It is not possible to cancel only part of a reservation. After cancellation, the renter will receive a voucher with a code equal to the value of the canceled reservation. This voucher is valid for one year from the date of cancellation and can only be used once in the Caretrade VOF webshop. In accordance with Article VI.53 of the Code of Economic Law, the right of withdrawal for distance selling does not apply. Caretrade VOF never issues refunds for canceled reservations.

ARTICLE XI. Liability

Caretrade VOF cannot be held liable for the consequences of an error committed by itself or one of its employees. Caretrade VOF can only be held liable in cases of gross negligence and/or intent.

ARTICLE XII. Jurisdiction

All disputes shall be settled in accordance with Belgian law and shall fall under the exclusive jurisdiction of the Courts of Hasselt.
